Dillon Eustace advises Oaktree in successfully opposing the examinership of KC Capital
Dillon Eustace’s Restructuring and Insolvency Group recently acted for Oaktree Capital Management (UK) LLP in successfully opposing the appointment of an examiner to KC Capital, a special purpose company established to develop an office block on Cuffe Street, known as the Greenside Building.
Upholding the first instance decision of His Honour Judge O’Connor in the Circuit Court, in his written judgment delivered on 6 March 2026 [2026] IEHC 115, Mr. Justice Twomey in the High Court went on to dismiss KC Capital’s appeal. KC Capital had built up over €53 million in debts to its secured creditor that was backed by Oaktree.
