We represent major Irish and international insurers, defending complex claims in areas such as road traffic accidents, employers’ liability and public liability claims, including catastrophic and fatal injury accidents. The team has specialist expertise in defending fraudulent and exaggerated claims, contesting cases as the circumstances demand and regularly achieving the withdrawal or dismissals of claims.

Dillon Eustace works with clients throughout the life cycle of a personal injury claim. We assist with all aspects of the pre-litigation process, including detailed advices on liability, quantum and strategic approach, as well as engagement with the Injuries Resolution Board. We further represent our clients’ interests from the commencement of litigation proceedings to their conclusion. This includes the defence of court litigation, dealing with claims of varying values in all court jurisdictions, engaging in alternative dispute resolution forums, such as mediations and arbitrations and successfully appealing and achieving significant reductions in awards in the Court of Appeal.

Relevant Experience
  • Representing the defendant insurer in Lipinski (a Minor) v Whelan [2022] IEHC 452, the first case before the High Court in which The Judicial Council Personal Injuries Guidelines were adopted.

  • Acting for the defendant in an appeal to a High Court award of damages arising from a road traffic accident, securing a reduction in excess of 45% for general damages before the Court of Appeal.  

  • Representing a defendant client in securing a dismissal of a claim for significant damages arising from an alleged debilitating injury by way of an application pursuant to Section 26 of the Civil Liability and Courts Act 2004.

  • Acting for Educational Boards in the defence of personal injury claims arising in physical education and woodwork classes in schools.

  • Representing the MIBI in personal injury claims arising from road traffic accidents involving uninsured drivers, providing a proactive and efficient service to ensure cost-effective outcomes.  

  • Acting for insurer client in pre litigation steps before the Injuries Resolution Board in respect of an employee liability claim, including representing their position in a mediation conducted by the Board.   

  • Defending a complex catastrophic injury claim involving brain trauma, including investigations and advices on liability and quantum.
