Our Asset Recovery and Fraud team has significant experience in advising domestic and international clients on enforcement, asset recovery, insolvency, financial and cyber-fraud, and regulatory investigations

We have expertise in all forms of dispute resolution from local proceedings to complex, cross jurisdictional and high-value cases in Ireland’s dedicated Commercial Court. We are skilled in bankruptcy, insolvency, international asset-tracing and multi-jurisdictional enforcement of judgments and are committed to finding the most practical and commercial solutions for our clients.

Relevant Experience
  • Acting for a global aircraft operating lessor in obtaining judgment in excess of US$ 400m in the Irish Commercial Court against a cargo-airline and logistics company arising from the repatriation of aircraft to Russia in breach of grounding orders and lease obligations and obtaining a worldwide freezing order and the appointment of a receiver over shares in aid of execution of the judgment. Advising client on enforcement of mareva order freezing assets in other European member states and the Middle East.

  • Advising court appointed liquidator to a company which imported high-end luxury vehicles into the Irish market in Commercial Court proceedings claiming fraud (Missing Trader Intra-Community VAT fraud) against former directors.

  • Representing Irish and international financial institutions in the reversal of fraudulent asset transfers.

  • Acting for financial services clients in relation to fraud perpetrated from the use of cloned websites.

  • Representing investors and fund service providers in litigation worth in excess of $1 billion arising out of the Bernard Madoff fraud.

  • Acting for Danske Bank A/S and a receiver in injunctive proceedings which successfully traced assets through two international jurisdictions.

  • Acting in Commercial Court application for the enforcement and recognition of a foreign arbitral award of almost $280.

  • Acting for a US financial institution in Commercial Court proceedings arising from the bankruptcy of a high-net-worth Irish individual.
