We advise on all aspects of arbitration under the Arbitration Act 2010, which adopts the UNCITRAL Model Law and we have extensive experience acting in domestic and international commercial arbitrations covering a wide range of disputes. We have particular expertise in acting in arbitrations on behalf of insurance company clients in respect of disputes involving complex policy coverage issues, business interruption claims, subrogated claims and defending insured legal actions.

Conscious of time and cost factors for clients, we have resolved many disputes by mediation and our lawyers are experienced in the nuances of successful mediation. We work with a wide range of clients to advise on options to resolve disputes without recourse to litigation and have acted in mediations and conciliations relating to a range of matters including shareholder disputes, breach of contract claims, professional negligence actions and debt recovery. Our dedicated personal injury defence team, which is focused on providing our clients with cost-effective strategies to efficiently manage personal injury claims, have a strong track record for securing advantageous settlements through mediation and have also represented clients’ interests in the Injuries Resolution Board mediation process.

Relevant Experience

• Representing an insurance client in an arbitration in relation to policy coverage issues and business interruption claims arising from Covid-19.

• Acting for a semi-state body in an arbitration of a dispute with a joint venture partner regarding the development of a substantial commercial property.

• Acting for insurer client in pre litigation steps before the Injuries Resolution Board in respect of an employee liability claim, including representing their position in a mediation conducted by the Board.  

• Acting for a member of the design team in a conciliation under a Public Works Contract relating to alleged defects in the redevelopment of a sports facility.

• Acting for a commercial transportation business in an arbitration concerning a dispute over damage to haulage consignments.

• Acting in a successful mediation in respect of a complex injury case arising from a workplace accident.

• Acting for insurer client in an arbitration commenced by a policy holder in respect of a refusal to provide insurance cover for an accident on account of the underlying activity not being covered by the terms of the policy.

• Acting in an arbitration of a dispute among insurers of a solicitor as to the responsive policy.

• Acting in an arbitration in respect of a substantial property damage and business interruption action arising from declinature of the claim.
