Our Employment team advises on all aspects of employment law, including employment relationships, employment contracts, termination issues, and transfer of undertakings

We provide practical and commercial tailored solutions to employment law issues. We advise domestic and international clients on all aspects of the employment relationship and at every stage of the employment cycle – from the recruitment process through employment contracts, employee handbooks and employment policies to termination issues. The team advises on day-to-day issues such as leave, health and safety, protected disclosures, data subject access requests and flexible and remote working arrangements. We are highly experienced advisers on the strategic employment law aspects of mergers and acquisitions – such as Transfer of Undertakings Regulations, redundancies and industrial relations.

Our advice covers specialist areas, including contracts and taxation, restrictive covenants, injunctions, discrimination, and data protection. We have an excellent reputation for advising on disciplinary procedures and for handling the various forms of employment dispute resolution, including proceedings before the courts, the Workplace Relations Commission and the Labour Court. Our team includes highly skilled negotiators and qualified mediators with significant experience in alternative methods of dispute resolution.

Representative experience covers:

  • Advising on workplace behaviour, drafting and enforcement of policies, employee handbooks, and service agreements.

  • Employment contracts, payment of wages, unfair dismissals, sexual harassment, workplace diversity and discrimination.

  • Redundancies, restrictive covenants (non-compete and non-solicitation clauses).

  • Restructuring and collective redundancies, consultation and communications management.

  • Exit procedures and packages, drafting compromise agreements.

  • Mediation services in relation to employment disputes.

  • Advising in relation to claims in the Workplace Relations Commission, the Labour Court and the High Court.

  • Advising on the consequences of the implementation of the EU Directive 2008/104/EC on temporary agency work.

  • Advising on employment law aspects of the Central Bank of Ireland’s fitness and probity regime.

Relevant Experience

Advising a company in relation to a series of redundancies and the issues arising.

Advising an employee in relation to an injunction preventing the termination of employment.

Reviewing and amending an employment contract and staff handbook for an entity regulated by the Central Bank of Ireland to take account of SEAR.

Advising on a subject access request from an employee.

Advising an employer in relation to a worker’s status, including the successful defence of a claim to the WRC and an Appeal to the Labour Court.

Advising a company in relation to the application of TUPE.

Advising a company in relation to sexual harassment allegations.
